These Terms of Service (“Terms”) govern your access to and use of the website located at https://www.the-hpc.com/ (“Website”) and any information, content, resources, enquiry forms, booking forms, online features, digital material, service information, event information or other services described, promoted, enquired about or supported through the Website.
This Website is operated by Elite Gentlemen (Pty) Ltd, EG Brand, operating as The Human Performance Centre (“HPC”, “we”, “us” or “our”).
HPC does not sell directly through the Website and does not process transactions on the Website. The Website is used for information, enquiries, consultations, bookings, resources, service explanation and related communication.
By accessing or using the Website, submitting a form, making an enquiry, booking a consultation, requesting an assessment, registering for an event, subscribing to communication, posting a comment, liking content, or otherwise interacting with us through the Website, you agree to these Terms, together with our Privacy Policy and any other policies, notices, booking terms, service agreements or written terms that apply to a specific service.
If you do not agree to these Terms, you must not access or use the Website.

2. Scope of these Terms
These Terms apply to your use of the Website and to general online interactions with HPC.
They do not replace a separate written agreement, client contract, event agreement, corporate proposal, training agreement, coaching agreement, school or club agreement, online coaching terms, invoice terms, or any other service-specific terms agreed between you and HPC.
If there is a conflict between these Terms and a separate written agreement signed or accepted for a specific service, the service-specific agreement will apply to that service, unless the agreement says otherwise.
3. HPC services
HPC may provide information, enquiries, consultations, assessments, bookings, services or resources relating to:
in-person performance coaching and training;
biomechanics-informed training and movement coaching;
personal training and strength training;
sports performance training for athletes;
youth athlete development;
online coaching and remote training support;
nutrition, lifestyle and habit guidance;
corporate health and workplace wellness services;
trainer education, seminars, workshops, events and related learning resources;
service packages connected to HPC’s work.
The Website is used to explain HPC’s services, receive enquiries, support bookings or consultations, share resources, and help prospective clients understand whether HPC may be the right fit.
HPC does not sell directly through the Website and does not process transactions on the Website. Any pricing, package, consultation, assessment or service arrangement will be confirmed separately by HPC through direct communication, a proposal, an invoice, a booking confirmation, a service agreement, onboarding material or another written communication.
4. Website information is general information only
The content on this Website is provided for general information, education, marketing and enquiry purposes.
Although we aim to keep the Website accurate, clear and up to date, Website content should not be treated as personalised advice, medical advice, diagnosis, treatment, rehabilitation advice, legal advice, financial advice, or a substitute for an assessment, consultation or professional guidance.
Your use of any Website information is at your own risk. You should not rely on Website content as the sole basis for making decisions about your health, training, injuries, nutrition, performance, business, employees, athletes, children, team or organisation.
Where your situation requires medical, psychological, rehabilitation, legal, tax, accounting, financial or other regulated professional advice, you should consult an appropriately qualified professional.
5. No medical advice and no emergency service
HPC is a human performance and coaching environment. Unless expressly stated in writing, HPC does not provide medical diagnosis, medical treatment, emergency medical services, physiotherapy, psychology, dietetic treatment, or any other regulated healthcare service through the Website.
Information on the Website about training, nutrition, lifestyle, injuries, mobility, performance, wellness, pain, movement or the body is not medical advice.
The Website, webforms, email, social media pages and booking tools are not emergency channels. If you are experiencing a medical emergency, serious pain, injury, distress or urgent health issue, contact emergency services or an appropriate healthcare professional immediately.
6. Health, training and performance risk
Physical training, movement, exercise, sports performance work, nutrition changes and lifestyle changes can carry risk. These risks may include discomfort, fatigue, soreness, injury, aggravation of existing conditions, or other physical or health-related consequences.
Before starting any training, coaching, nutrition, performance or wellness programme, you are responsible for ensuring that you are medically and physically able to participate.
You must disclose relevant information honestly and accurately during any enquiry, consultation, assessment, onboarding or service delivery process. This may include information about injuries, pain, medical conditions, medication, limitations, previous training history, nutrition, lifestyle, sleep, hydration, stress, sport, goals, and any professional restrictions or medical advice you have received.
HPC may refuse, pause, adapt, postpone or stop a service where we reasonably believe that doing so is necessary to protect safety, quality, service fit, client wellbeing, staff wellbeing, or HPC standards.
7. Assessments, consultations and service fit
HPC may require an assessment, consultation, screening process or onboarding process before accepting a person into a service.
Submitting a form, sending an enquiry, booking a consultation, attending an event, requesting an assessment, or interacting with the Website does not automatically make you a client and does not guarantee that HPC will accept you, your child, your athlete, your business or your organisation for a service.
HPC reserves the right to decline, delay or recommend a different service where we believe that:
the service is not suitable for the person or organisation;
more information is needed;
another professional should be consulted first;
the requested service falls outside HPC’s scope;
the person or organisation does not fit HPC’s standards, process or service model;
safety, quality or capacity concerns apply.
We will not refuse service on any unlawful or unfairly discriminatory basis.
8. Minors and young athletes
If the Website, enquiry, consultation, assessment or service relates to a child or young athlete, a parent or legal guardian must provide the relevant information, consent to the enquiry or service process, and remain responsible for decisions relating to that child or young athlete.
By submitting information about a minor, you confirm that you are the parent, legal guardian, or an authorised person acting with the required consent.
HPC may require additional written consent, waivers, assessment information, service agreements or onboarding forms before providing services to minors or young athletes.
9. Online coaching, digital delivery and third-party platforms
Where HPC provides online coaching, remote training support, programme delivery, check-ins, communication, habit tracking or related services, those services may be delivered through third-party platforms such as Kahunas, email, WhatsApp, video calls, online forms, spreadsheets or other tools used by HPC.
The app, platform or tool used to deliver a service is not the service itself. The service is the coaching, programming, guidance, feedback, accountability and support provided by HPC according to the applicable service terms.
You are responsible for using any digital tools, login credentials, app access, files, links or communication channels appropriately and securely.
Third-party tools may have their own terms and privacy policies. You should review those terms where they apply.
10. Corporate, school, club and partner services
Where HPC provides services to companies, schools, clubs, academies, sports organisations, partners or other entities, the scope of work, pricing, deliverables, responsibilities, cancellation terms, attendance requirements, data handling, staff or athlete participation, reporting and other commercial terms will be confirmed in the relevant proposal, agreement, invoice or written communication.
A person submitting an enquiry on behalf of a company, school, club, organisation or other entity confirms that they are authorised to make the enquiry and to provide the information submitted.
11. Events, seminars, workshops and educational content
HPC may offer or promote events, seminars, workshops, talks, trainer education, corporate sessions, athlete sessions, youth development sessions or other educational content.
Registration for an event does not guarantee attendance unless confirmed by HPC or the relevant event platform. Event details, capacity, venue, time, speaker line-up, content, pricing and availability may change where reasonably necessary.
Unless expressly stated in writing, attending an event, seminar, workshop or educational session does not make you an HPC client and does not replace an assessment, consultation, coaching process, medical consultation or service agreement.
Where an HPC course, workshop, seminar or trainer education product is offered, any certificate, attendance record, practical outcome or educational status will be described in the relevant course or event material. HPC does not claim formal accreditation unless expressly stated in writing.
12. Prices, quotes, invoices and payment
The Website may describe HPC’s services, divisions, consultations, assessments, events, resources or service options, but it does not process transactions and does not function as an online store.
Prices, fees, packages, event costs, service costs and related information may change from time to time without notice, unless a written quote, invoice, agreement or booking confirmation states otherwise.
Any price displayed or discussed through the Website is provided for general information only and may be subject to correction, availability, assessment, service fit, package selection, written confirmation, tax treatment or other conditions.
Anton / HPC invoices separately for training and related services through Zoho Invoicing. Zoho Invoicing does not currently connect to any payment gateways for HPC. Payments are handled outside the Website and outside Zoho Invoicing’s payment gateway functionality through the payment methods communicated directly to the client.
You agree to provide current, complete and accurate billing, contact and account information where required for invoicing, service communication or administration.
HPC may refuse, cancel, correct, delay or amend an enquiry, booking, quote, invoice or service request where information is inaccurate, incomplete, suspected to be fraudulent, affected by an obvious error, unavailable, unsuitable, or not yet confirmed by HPC.
13. Cancellations, refunds, returns and postponements
Cancellation, refund, transfer, postponement, missed-session, no-show and expiry terms may differ depending on the service, event, package, consultation, assessment, coaching programme, corporate agreement, online coaching arrangement or educational product.
Because HPC does not sell directly through the Website, the applicable cancellation, refund, payment and service terms will be communicated in the relevant quote, invoice, booking confirmation, service agreement, event terms, onboarding material or written communication.
Unless otherwise agreed in writing, you are responsible for reviewing the applicable cancellation, refund and payment terms before accepting a quote, making payment, booking a service, registering for an event or starting a service with HPC.
Nothing in these Terms is intended to limit any rights you may have under applicable South African consumer protection laws, including rights that cannot lawfully be excluded, limited or waived.
If HPC ever decides to sell physical products, digital products, services or other goods directly through the Website in future, the Website terms must be updated before those sales begin, and returns, replacements, repairs or refunds will be handled according to the applicable returns policy, product terms and South African law.
14. Consumer rights
Where the Consumer Protection Act, 68 of 2008, the Electronic Communications and Transactions Act, 25 of 2002, or any other consumer protection law applies, nothing in these Terms is intended to exclude, restrict or limit any right, remedy, warranty, protection or obligation that cannot lawfully be excluded, restricted or limited.
Any limitation of liability, disclaimer, cancellation term, refund term, return term or service term in these Terms applies only to the maximum extent permitted by law.
15. Accuracy, availability and changes to the Website
We aim to ensure that information on the Website is useful and reasonably accurate, but we do not guarantee that it will always be complete, current, error-free, uninterrupted, secure or available.
The Website may contain historical information, older content, past event information, old pricing, previous service descriptions, outdated images or content that is provided for reference only.
We may update, correct, remove, suspend, change or discontinue any part of the Website, service information, resource information, pricing, forms, features or content at any time without notice.
We are not liable to you or any third party for any Website modification, price change, suspension, discontinuance, content change or availability issue, except where liability cannot lawfully be excluded.

If you submit ideas, feedback, suggestions, proposals, testimonials, comments or other non-confidential material to us, you give HPC permission to use, edit, reproduce, publish, distribute, display and adapt that material for business, service, operational, marketing or improvement purposes, without compensation to you, unless we have agreed otherwise in writing.
Personal information submitted through comments, likes, forms or other Website features is handled according to our Privacy Policy.
17. Intellectual property
All Website content, including text, images, graphics, layouts, design elements, logos, trade names, service names, videos, audio, downloads, resources, course material, educational material, frameworks, copy, forms, brand elements and other materials, belongs to HPC, Elite Gentlemen (Pty) Ltd, EG Brand, our licensors, our partners or the relevant rights holders.
You may view and use the Website for personal, lawful and non-commercial purposes only, unless we give you written permission to do otherwise.
You may not copy, reproduce, modify, publish, distribute, sell, resell, exploit, scrape, download in bulk, mirror, frame, pass off, claim ownership of, or commercially use any Website content or HPC material without our prior written permission.
You may not use HPC’s name, brand, logo, images, content, programmes, frameworks, resources, course material, testimonials or service descriptions in a way that misleads people, damages HPC, suggests false endorsement, or infringes our rights.

The Website may include links, embeds, forms, integrations, content, tools, social media links, booking links, event links, maps, videos, resources or services provided by third parties.
Third-party websites, platforms and tools are not controlled by HPC. We are not responsible for their content, accuracy, availability, security, privacy practices, terms, services, actions or failures.
Your use of any third-party website, tool or platform is at your own risk and may be governed by that third party’s own terms and privacy policy.
19. Personal information and privacy
Your submission of personal information through the Website, forms, comments, likes, enquiries, bookings, subscriptions or other interactions is governed by our Privacy Policy.
Our Privacy Policy explains how we collect, use, store, share and protect personal information, including information collected through Squarespace, Zoho CRM, Zoho Invoicing, Google Analytics, Google Ads, Google Search Console, Squarespace Email Campaigns, Notion, Tally, Kahunas, Google Docs, Google Sheets and other business tools.
You should read our Privacy Policy before submitting personal information through the Website.
20. Prohibited uses
You may not use the Website, its content, forms, tools, comments, likes or any related service:
for any unlawful, fraudulent, harmful or unauthorised purpose;
to violate any applicable law, regulation, court order or third-party right;
to infringe our intellectual property rights or anyone else’s rights;
to harass, abuse, threaten, defame, intimidate, discriminate against or harm any person;
to submit false, misleading, incomplete or fraudulent information;
to upload or transmit viruses, malware, worms, harmful code or destructive technology;

To the maximum extent permitted by law, we do not guarantee, represent or warrant that:

22. Results are not guaranteed
HPC’s work depends on many factors, including assessment findings, training history, health status, injuries, consistency, nutrition, sleep, hydration, effort, attendance, communication, stress, lifestyle, compliance, environment, goals, coaching fit and other individual or organisational factors.
We do not guarantee specific results, including weight loss, muscle gain, pain reduction, injury prevention, team selection, competition performance, bursaries, qualification outcomes, business performance, employee health outcomes, productivity gains, revenue growth, corporate wellness results or any other specific result.
Testimonials, case studies, examples, content, images, posts, event material or client stories are not guarantees that you, your child, your athlete, your team, your business or your organisation will achieve the same or similar results.
23. Limitation of liability
To the maximum extent permitted by law, HPC, Elite Gentlemen (Pty) Ltd, EG Brand, our directors, employees, contractors, agents, partners, suppliers and service providers will not be liable for any indirect, incidental, special, punitive, consequential or similar damages, including loss of profits, loss of revenue, loss of savings, loss of data, loss of opportunity, business interruption, reputational harm or similar loss arising from or connected to your use of the Website or any Website content.
To the maximum extent permitted by law, our total liability for any claim arising from or connected to the Website or these Terms will be limited to the amount you paid to HPC for the specific service, event, package, consultation, assessment, coaching arrangement or Website-related interaction giving rise to the claim, or, if you paid nothing, to the minimum amount permitted by applicable law.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot be excluded under applicable consumer protection law.
24. Indemnity
To the maximum extent permitted by law, you agree to indemnify and hold harmless HPC, Elite Gentlemen (Pty) Ltd, EG Brand, our directors, employees, contractors, agents, partners, suppliers and service providers from any claim, loss, damage, cost, liability or expense arising from:
your breach of these Terms;
your misuse of the Website;
your unlawful conduct;
your infringement of any third-party right;
information, comments, submissions or content you provide;
your failure to provide accurate information where required;
your unauthorised use of HPC content, brand assets, resources or intellectual property.
This indemnity applies only to the extent permitted by applicable law.

By using the Website, submitting a form, sending us an email, accepting a quote, making a booking, registering for an event, subscribing to communication or otherwise communicating with us electronically, you consent to receiving communication from us electronically where lawful and appropriate.
Electronic communication may include emails, form responses, booking confirmations, invoices, payment-related records, notices, service communication, marketing emails, links, PDFs, messages or other digital records.

These Terms, together with our Privacy Policy and any policies, notices, service-specific terms, booking terms, invoices, proposals, agreements or written communications that apply to a specific service, form the agreement between you and HPC regarding your use of the Website.
These Terms replace any previous Website terms or online store terms published on an earlier version of the Website.
31. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa.
Where a dispute arises from or relates to these Terms, the Website or any Website-related interaction, the parties will first try to resolve the dispute in good faith through direct communication.
If the dispute cannot be resolved informally, it may be referred to the appropriate court, tribunal, regulator, ombud, mediation process, arbitration process, or other lawful dispute resolution forum with jurisdiction under South African law.
Nothing in these Terms prevents a consumer from using any dispute resolution process or remedy available under applicable South African law.
